Q. Basically, in a nutshell, what are Patents?

Patents are basically just monopolies given to inventors which last for about 20 years. This monopoly gives the inventor or owner of the patent the ability to stop others from making, using, and selling the invention.

 

What types of patents are there?

 

1. Utility Patents

2. Design Patents

3. Method Patents

 

Process or business method patents protect unique and novel processes which achieve some specific function or event. Examples include algorithms to pick stocks and bonds for insertion or entry into a hedge fund or mutual fund. Other examples include Amazon's controversial one-click patent.

 

Design patents are the most misunderstood type of patent application. Indeed, the word "Design Patent" is almost an oxymoron if you believe that the "design" covers the way an invention is made, composed, and engineered. Instead, Design Patents only cover the unique aesthetic look of a product. And this look, or ornamental features cannot, by definition, have any functional use whatsoever.

 

Example of a Design Patent.

 

A vodka bottle with a unique shape which does not include a traditional bottle neck found on most beverage bottles. The lack of a bottleneck does not have, or does not give the bottle any functional or utility advantages at all.
